The key points
- You must be at least 18 to hold your own TIMS account, and you are responsible for activity under it.
- Training providers are responsible for the courses and programmes they publish; TIMS operates the platform and collects payment on their behalf.
- Refunds follow the provider's stated policy and Malaysian consumer law.
- PRISM results are for personal development only and must not be used for hiring, promotion or dismissal decisions.
- These Terms are governed by the laws of Malaysia.
1.About these Terms
- 1.1
TIMS (the Platform) is operated by TIMS Sdn Bhd (TIMS, we, us or our). The Platform includes the website at tims.com.my, its web applications, the TIMS NFC Digital Profile Card and related services.
- 1.2
By creating an account, or by accessing or using the Platform, you agree to these Terms. If you do not agree, you must not use the Platform.
- 1.3
If you use the Platform on behalf of an organisation, you confirm that you are authorised to accept these Terms for that organisation, and you includes that organisation.
- 1.4
Some services have additional terms, such as the Privacy Notice, the Data Processing Agreement for organisations, and the terms shown at checkout or on a listing. Those terms form part of this agreement. If they conflict with these Terms, the more specific terms apply to that service.

3.Eligibility and accounts
- 3.1
You must be at least 18 years old to hold your own Account.
- 3.2
You must give accurate and complete information when you register and keep it up to date.
- 3.3
Each Account is for one person or one organisation. You must not share your login details or let anyone else use your Account.
- 3.4
You are responsible for all activity under your Account. Keep your password confidential and tell us immediately at support@tims.com.my if you suspect unauthorised use.
- 3.5
We may ask you to verify your identity, and may refuse or suspend an Account where we reasonably suspect false information, misuse or a breach of these Terms.
4.Using the Platform
- 4.1
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable and revocable right to access and use the Platform for its intended purpose.
- 4.2
We work to keep the Platform available and secure, but we do not guarantee that it will be uninterrupted or error-free. We may carry out maintenance, and we may change, add or remove features.
- 4.3
Some features depend on your role. What you can see and do is set by your Account type and, for Organisation users, by the roles and permissions your Organisation assigns.
5.Learners
- 5.1
When you enrol in Training, you enter into an arrangement with the Training Provider for the delivery of that Training. The Training Provider is responsible for delivering it as described.
- 5.2
You must attend and take part in Training in line with the Training Provider's reasonable instructions, including attendance and assessment requirements for a Certificate.
- 5.3
If your enrolment is sponsored or assigned by an Organisation, your Organisation may approve, change or cancel it, and can see your enrolment, attendance, assessment and completion records for that Training.
6.Organisations
- 6.1
An Organisation is responsible for the users it invites or approves, and for the roles and permissions it gives them.
- 6.2
An Organisation must have a lawful basis, and give any notices required by law, before adding employees or sharing their personal data on the Platform. The Data Processing Agreement sets out how we process that data on the Organisation's behalf.
- 6.3
An Organisation is responsible for its training approvals, budgets and assignments, and for any quotation it accepts from a Training Provider.
- 6.4
Hiring tools on the Platform, such as CV comparison, candidate assessments and interview question sets, provide decision support only. The Organisation remains responsible for using them lawfully and fairly, for giving candidates any required notice, and for its hiring decisions.
7.Training Providers
- 7.1
Training Providers must apply and be approved before publishing. We may ask for registration documents and other evidence, and may approve, reject, suspend or withdraw approval at our discretion.
- 7.2
A Training Provider is responsible for the accuracy and legality of its listings, including content, trainers, schedules, venues, prices, inclusions, accreditation, and any statement that Training is claimable under HRD Corp.
- 7.3
A Training Provider must hold all licences, approvals and insurance needed to deliver its Training, and must deliver it as described.
- 7.4
If a Training Provider cancels or materially changes Training, it must tell affected Learners and Organisations promptly through the Platform and offer an alternative session or a refund.
- 7.5
A Training Provider is responsible for the Certificates it issues through the Platform and must issue them only to Learners who have met its completion requirements.
- 7.6
We may review, edit for format, suspend or remove any listing that breaches these Terms, applicable law or our listing standards.
8.Bookings, fees and payment
- 8.1
Training Providers set the prices for their Training. Prices are shown in Malaysian Ringgit (RM) unless stated otherwise, and any applicable tax is shown at checkout.
- 8.2
Payments are processed by our third-party payment gateways. We do not store your full card details.
- 8.3
TIMS collects payment on behalf of the Training Provider and pays the Training Provider the amount received less the applicable platform fees.
- 8.4
An enrolment is confirmed when payment is received or, for free or Organisation-sponsored Training, when it is approved. Receipts are issued through the Platform.
- 8.5
Quotations for programmes are issued by Training Providers and are valid for the period stated in the quotation. Once an Organisation accepts a quotation, the quoted terms apply to that booking.
9.Cancellations, rescheduling and refunds
- 9.1
You can ask to move to another session through the Platform. Rescheduling depends on the Training Provider's approval and on seat availability.
- 9.2
Refund eligibility depends on the Training Provider's refund policy shown on the listing or at checkout, and on your rights under Malaysian consumer protection law.
- 9.3
If a Training Provider cancels Training and you do not accept an alternative, you are entitled to a refund of the amount you paid for it.
- 9.4
Approved refunds are returned to the original payment method. Processing times depend on your bank or payment provider.
10.HRD Corp claims
- 10.1
Where a listing says that Training is claimable under HRD Corp, that information comes from the Training Provider.
- 10.2
You are responsible for checking your eligibility and for submitting any claim to HRD Corp. We do not guarantee that a claim will be approved.
11.Certificates and verification
- 11.1
Certificates issued through the Platform carry a certificate ID that anyone can check on the public verification page. The verification page shows limited details only.
- 11.2
We keep issued Certificates for 7 years for regulatory audit.
- 11.3
A revoked Certificate remains on the verification page marked as "revoked", so that anyone relying on it gets an accurate result.
- 11.4
You must not alter, forge or misrepresent a Certificate.
12.PRISM and development assessments
- 12.1
PRISM and all TIMS development assessments are development tools. Their results, including archetypes, dimension scores, narratives and reports, must not be used, in whole or in part, to make or inform hiring, promotion, retention, compensation or termination decisions, whether about the person who took the assessment or anyone else.
- 12.2
For Organisations, this is a material term of the service. A breach entitles us to suspend or terminate the Organisation's access. Development assessment data is kept separate from selection assessment tools and is not made available to hiring workflows.
- 12.3
PRISM is not a clinical instrument and gives no medical or psychological diagnosis. Results describe self-reported workplace patterns with stated confidence levels and should be read as input for development, not as fact.
- 12.4
Your Organisation can see your PRISM results only to the extent you choose to share them in your settings.
13.Digital Profile Card, NFC card and SOS
- 13.1
Your Digital Profile Card and NFC card show the information you choose to make public in your privacy settings.
- 13.2
If you turn on the SOS emergency profile, the emergency details you enter (such as blood type, allergies, medical conditions, medication and emergency contacts) will be visible to anyone who scans your card. Insurance details stay private.
- 13.3
The SOS profile is an aid only. It is not an emergency service. In an emergency, call 999.
- 13.4
Keep your emergency details accurate. Report a lost or stolen card promptly so that we can deactivate it.
14.Your content
- 14.1
Content you upload, such as profile photos, documents, support messages and reviews, remains yours.
- 14.2
You grant us a non-exclusive, royalty-free licence to host, store, copy and display that Content as needed to operate and improve the Platform, and to show it to the people you share it with.
- 14.3
You are responsible for your Content. You confirm that you have the rights to upload it and that it does not break the law or anyone else's rights.
- 14.4
We may remove Content that breaches these Terms or the law.
15.Intellectual property
- 15.1
We own the Platform, including its software, design, the TIMS and PRISM names and logos, and the PRISM assessment content, or we have the right to use them.
- 15.2
Training Providers own their Training content. Nothing in these Terms transfers ownership of it to TIMS or to Learners.
- 15.3
If you send us feedback or suggestions, we may use them without any obligation to you.
16.Prohibited conduct
You must not:
- (a)copy, scrape, resell or mirror the Platform or its content without our written permission;
- (b)use the Platform to distribute malware, unlawful content or misleading training or accreditation claims;
- (c)impersonate any person or organisation, or misrepresent your affiliation with them;
- (d)get around rate limits, access controls or other security measures, or probe or test the Platform's vulnerabilities without our permission;
- (e)access another person's Account or data without authorisation;
- (f)harass, abuse or discriminate against other users; or
- (g)use the Platform in any way that breaks Malaysian law or these Terms.
17.Third-party services
- 17.1
The Platform uses third-party services, such as payment gateways, email delivery and cloud hosting. Your use of those services may also be subject to their terms.
- 17.2
The Platform may link to third-party websites. We are not responsible for their content or practices.
18.Suspension and termination
- 18.1
You can close your Account at any time in Settings → Privacy.
- 18.2
We may suspend or terminate your Account or access, with notice where reasonable, if you breach these Terms, if we must do so by law, or to protect users or the Platform.
- 18.3
When an Account is closed, we handle your data as described in the Privacy Notice. Some records, such as payments and issued Certificates, are kept for the periods the law requires.
- 18.4
Clauses that by their nature should continue after termination, including those on fees, intellectual property, disclaimers, liability and governing law, continue to apply.
19.Disclaimers
- 19.1
The Platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we give no warranties other than those set out in these Terms.
- 19.2
We do not guarantee any particular training, career or employment outcome.
- 19.3
Some content on the Platform is generated with AI assistance, such as course descriptions and assessment narratives. It may contain errors, so check it before relying on it.
20.Limitation of liability
- 20.1
To the fullest extent permitted by law, we are not liable for any indirect or consequential loss, or for loss of profit, revenue, data or goodwill.
- 20.2
To the fullest extent permitted by law, our total liability to you for any claim relating to the Platform is limited to the fees you paid through the Platform in the 12 months before the event giving rise to the claim.
- 20.3
Nothing in these Terms limits or excludes liability for fraud, gross negligence, death or personal injury caused by negligence, or any liability that cannot be limited under Malaysian law, including your rights under the Consumer Protection Act 1999.
21.Indemnity
- 21.1
To the extent permitted by law, you agree to indemnify TIMS against claims, losses and reasonable costs arising from your breach of these Terms or your misuse of the Platform.
22.Privacy
- 22.1
We process personal data in line with the Personal Data Protection Act 2010 and our Privacy Notice. Organisations should also read the Data Processing Agreement.
23.Changes to these Terms
- 23.1
We may update these Terms from time to time. For material changes, we will give you at least 30 days' notice by email or through the Platform before they take effect.
- 23.2
If you keep using the Platform after the changes take effect, you accept the updated Terms. If you do not agree, you can close your Account.
24.Governing law and disputes
- 24.1
These Terms are governed by the laws of Malaysia.
- 24.2
If you have a complaint, please contact us first at support@tims.com.my so that we can try to resolve it.
- 24.3
Any dispute that cannot be resolved informally is subject to the jurisdiction of the courts of Kuala Lumpur. This does not affect any right you have to bring a claim before the Tribunal for Consumer Claims Malaysia, or any other statutory right you have.
25.General
- 25.1
These Terms, together with the documents they refer to, are the entire agreement between you and TIMS about the Platform.
- 25.2
If any part of these Terms is found to be invalid or unenforceable, the rest remains in effect.
- 25.3
If we do not enforce a right straight away, we have not waived it.
- 25.4
We may transfer our rights and obligations under these Terms to a related company or a successor. You may not transfer yours without our written consent.
- 25.5
We are not responsible for delays or failures caused by events beyond our reasonable control.
- 25.6
We may send you notices by email or through the Platform.
- 25.7
These Terms are available in English and Bahasa Malaysia. If the two versions differ, the English version prevails to the extent permitted by law.
